1. Acceptance of Terms

1.1. By using Mr Dokan, you agree to comply with these Terms and Conditions and all applicable laws and regulations of Bangladesh.

1.2. These terms become effective immediately when you access or use the Platform.

1.3. Mr Dokan reserves the right to update, modify, suspend, or replace any part of these Terms and Conditions at any time. Continued use of the Platform after changes are published will be treated as acceptance of the updated terms.

2. About Mr Dokan

2.1. Mr Dokan is an online pharmacy and healthcare-related e-commerce platform that allows users to search, order, and receive medicines and other permitted healthcare products.

2.2. Mr Dokan may operate through its own inventory, licensed pharmacy partners, delivery partners, and other authorized service providers.

2.3. All medicine-related services are intended to be conducted in accordance with applicable laws, rules, and regulatory requirements of Bangladesh.

2.4. Mr Dokan may expand its services from time to time, including but not limited to healthcare products, beauty products, personal care products, grocery items, or other lawful products.

3. User Account and Responsibilities

3.1. Users may be required to create an account using their phone number, email address, or other required information.

3.2. Users are responsible for providing accurate, complete, and updated information during registration and order placement.

3.3. Users are responsible for maintaining the confidentiality of their account credentials and OTP verification information.

3.4. Any activity performed through a user’s account will be considered the responsibility of that user.

3.5. Users must immediately notify Mr Dokan if they suspect unauthorized access or misuse of their account.

4. Services Provided

4.1. Mr Dokan allows users to browse, search, and order medicines and other available products through the Platform.

4.2. Product availability, price, discount, delivery area, and delivery time may vary depending on stock, supplier, pharmacy partner, location, and operational conditions.

4.3. Mr Dokan may accept orders for prescription and non-prescription medicines, subject to applicable legal requirements.

4.4. Mr Dokan reserves the right to reject, cancel, delay, or modify any order if required due to product unavailability, prescription issues, pricing errors, suspicious activity, regulatory restrictions, or operational limitations.

5. Prescription Medicine Policy

5.1. Certain medicines may require a valid prescription issued by a licensed medical practitioner.

5.2. Users must upload or provide a valid prescription when ordering prescription-only medicines.

5.3. Mr Dokan may verify prescriptions before confirming or delivering an order.

5.4. If a prescription is unclear, expired, invalid, incomplete, or inconsistent with the order, Mr Dokan may contact the user for clarification or cancel the relevant items.

5.5. Users are fully responsible for the accuracy and authenticity of the prescription and health-related information they provide.

5.6. Mr Dokan does not encourage self-medication. Users should consult a qualified doctor, pharmacist, or healthcare professional before using any medicine.

6. Product Information and Medical Disclaimer

6.1. Product descriptions, images, dosage information, generic names, brand names, manufacturer details, and other information shown on the Platform are provided for general informational purposes only.

6.2. Mr Dokan tries to keep product information accurate and updated, but does not guarantee that all information will always be complete, error-free, or current.

6.3. Information on the Platform should not be treated as medical advice, diagnosis, or treatment recommendation.

6.4. Users should always follow the advice of a qualified healthcare professional and read product packaging, labels, and instructions before using any medicine or healthcare product.

7. Pricing, Discounts, and Payment

7.1. Product prices shown on the Platform may change without prior notice.

7.2. Prices, discounts, offers, and availability may vary based on supplier, batch, stock, location, and promotional campaigns.

7.3. Final payable amount will be shown during checkout or on the invoice.

7.4. If there is a pricing error, stock issue, or supplier price change, Mr Dokan may contact the user before processing the order.

7.5. Available payment methods may include cash on delivery, digital payment, mobile financial services, card payment, or other methods supported by Mr Dokan.

7.6. If payment is made in advance and an order is canceled or partially fulfilled, eligible refunds will be processed according to Mr Dokan’s refund policy.

8. Order Confirmation and Fulfillment

8.1. Placing an order does not guarantee final acceptance of the order.

8.2. An order may be confirmed only after product availability, prescription requirements, payment status, delivery coverage, and other relevant conditions are verified.

8.3. Mr Dokan may contact the user by phone, SMS, email, app notification, or other available communication channels for order confirmation or clarification.

8.4. Mr Dokan reserves the right to cancel any order if the user cannot be reached, provides incorrect information, refuses to provide required prescription details, or violates these Terms and Conditions.

9. Delivery Policy

9.1. Delivery service may be available only in selected areas.

9.2. Delivery charge, estimated delivery time, and delivery availability may vary based on user location, order amount, product type, delivery partner, and operational capacity.

9.3. Estimated delivery time shown on the Platform is approximate and may change due to weather, traffic, strikes, holidays, stock issues, supplier delay, or other circumstances beyond Mr Dokan’s control.

9.4. Users must provide accurate delivery address, contact number, and delivery instructions.

9.5. Mr Dokan will not be responsible for delivery failure or delay caused by incorrect address, unreachable phone number, recipient unavailability, or refusal to accept delivery.

10. Order Verification at Delivery

10.1. Users are requested to check the delivered products carefully at the time of receiving the order.

10.2. Users should verify product name, quantity, packaging condition, expiry date, and invoice details.

10.3. Users should not accept damaged, tampered, leaked, or suspicious packages.

10.4. Once an order is received and accepted, return or refund requests may be limited, especially for medicines and sensitive healthcare products.

11. Return, Replacement, and Refund Policy

11.1. Due to the sensitive nature of medicines and healthcare products, returns may be accepted only under limited conditions.

11.2. Return, replacement, or refund may be considered if:

• The wrong product was delivered.

• The delivered product was damaged or defective.

• The product was expired at the time of delivery.

• The order was canceled after successful advance payment.

• Mr Dokan failed to supply a paid item.

11.3. Users must contact Mr Dokan within a reasonable time after delivery with proper proof, such as photos, invoice, order ID, or other required evidence.

11.4. Products must be unused, unopened, and in original packaging where applicable.

11.5. Mr Dokan reserves the right to reject return or refund requests if the product has been used, damaged after delivery, improperly stored, or the complaint is found invalid.

11.6. Refund processing time may vary depending on payment method, bank, mobile financial service provider, or payment gateway.

12. Cancellations

12.1. Users may request cancellation before an order is processed, packed, dispatched, or delivered.

12.2. Mr Dokan may cancel any order due to product unavailability, invalid prescription, pricing error, payment issue, delivery limitation, suspicious activity, or violation of these terms.

12.3. Once an order is dispatched, cancellation may not be possible.

13. User Conduct and Prohibited Activities

Users must not use Mr Dokan for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose. Users must not:

13.1. Provide false, misleading, or fraudulent information.

13.2. Upload fake, altered, expired, or unauthorized prescriptions.

13.3. Attempt to purchase restricted products illegally.

13.4. Interfere with the security, operation, or performance of the Platform.

13.5. Attempt unauthorized access to another user’s account or Mr Dokan’s systems.

13.6. Copy, misuse, modify, distribute, or commercially exploit Platform content without permission.

13.7. Post or submit abusive, defamatory, obscene, misleading, illegal, or harmful content.

14. Intellectual Property Rights

14.1. The Mr Dokan name, logo, design, software, content, images, product presentation, interface, and related materials are owned by or licensed to Mr Dokan.

14.2. Users are granted a limited, non-transferable, non-exclusive right to access and use the Platform for personal and lawful purposes only.

14.3. No user may copy, reproduce, distribute, modify, sell, or exploit any part of the Platform without prior written permission from Mr Dokan.

15. Third-Party Services and Links

15.1. Mr Dokan may use third-party service providers for payment processing, delivery, analytics, communication, hosting, or other operational purposes.

15.2. The Platform may contain links or references to third-party websites, services, or promotions.

15.3. Mr Dokan is not responsible for third-party content, policies, security practices, service quality, or any loss caused by third-party platforms.

16. Promotions, Coupons, and Referral Program

16.1. Mr Dokan may offer discounts, coupons, referral rewards, cashback, promotional campaigns, or loyalty benefits from time to time.

16.2. Promotional offers may be subject to specific terms, validity periods, minimum order values, product exclusions, location restrictions, or usage limits.

16.3. Referral rewards may apply only when a referred new customer successfully places and receives an eligible first order using a valid referral code.

16.4. Mr Dokan reserves the right to modify, suspend, cancel, or reject any promotion, coupon, or referral benefit in cases of misuse, fraud, technical error, or policy violation.

17. Privacy and Data Protection

17.1. Mr Dokan respects user privacy and aims to protect personal information.

17.2. Users may be required to provide personal information such as name, phone number, email address, delivery address, prescription details, order history, and payment-related information.

17.3. Mr Dokan may use user information for account management, order processing, delivery, customer support, prescription verification, payment processing, service improvement, legal compliance, and communication.

17.4. Mr Dokan may share necessary information with pharmacy partners, delivery partners, payment service providers, technology providers, or legal authorities where required.

17.5. Mr Dokan will take reasonable measures to protect user data, but internet-based communication and digital storage may not always be completely secure.

18. Security and Platform Availability

18.1. Mr Dokan will try to keep the Platform secure, available, and functional.

18.2. However, Mr Dokan does not guarantee that the Platform will always be uninterrupted, error-free, virus-free, or fully secure.

18.3. Services may be temporarily unavailable due to maintenance, technical issues, cyber incidents, server downtime, internet disruptions, or circumstances beyond control.

18.4. Mr Dokan may suspend or restrict access to the Platform for security, maintenance, investigation, or policy enforcement purposes.

19. Limitation of Liability

19.1. Mr Dokan will not be liable for indirect, incidental, special, consequential, or unforeseeable losses arising from use of the Platform.

19.2. Mr Dokan will not be liable for loss caused by incorrect user information, misuse of medicine, failure to follow medical advice, third-party service issues, delivery delays, force majeure events, or unauthorized account access caused by user negligence.

19.3. To the maximum extent permitted by law, Mr Dokan’s liability for any claim will be limited to the amount paid by the user for the relevant order or service.

20. Compliance with Laws

20.1. Mr Dokan intends to operate in accordance with applicable laws, rules, regulations, and regulatory requirements of Bangladesh.

20.2. Users must also comply with all applicable laws while using the Platform.

20.3. Mr Dokan may disclose user information, order details, prescription records, or transaction data to government authorities, regulators, courts, or law enforcement agencies when legally required.

21. Force Majeure

21.1. Mr Dokan will not be responsible for failure or delay in service caused by events beyond its reasonable control.

21.2. Such events may include natural disasters, floods, fire, pandemic, epidemic, war, political unrest, strikes, government restrictions, transport disruption, internet failure, server failure, power outage, or other unavoidable circumstances.

22. Suspension and Termination

22.1. Mr Dokan may suspend, restrict, or terminate a user’s account or access to the Platform if the user violates these Terms and Conditions.

22.2. Mr Dokan may also take action if fraudulent, abusive, suspicious, illegal, or harmful activity is detected.

22.3. Users may stop using Mr Dokan at any time.

23. Governing Law and Jurisdiction

23.1. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Bangladesh.

23.2. Any dispute arising from these Terms and Conditions, the Platform, or any transaction through Mr Dokan shall be subject to the jurisdiction of the competent courts of Bangladesh.
